सुप्रीम कोर्ट (Supreme Court) ने मंगलवार को एक फैसले के दौरान अदालतों (courts) को विकिपीडिया (Wikipedia) के भरोसे न रहने की सलाह (Advice not to rely) दी है। शीर्ष अदालत ने यह भी ताकीद की है कि कानूनी मसलों (legal issues) को सुलझाने के लिए इसका सहारा न लिया जाए। जस्टिस सूर्यकांत और विक्रम नाथ की बेंच ने कहा कि विकिपीडिया पर जानकारी आम लोगों द्वारा ही डाली जाती है। फिर इसकी एडिटिंग कोई भी यूजर कर सकता है। कोर्ट ने कहा कि ऐसे में यहां पर मौजूद सूचनाओं की सटीकता नहीं आंकी जा सकती है।
पूरी तरह भरोसेमंद नहीं
एक मामले की सुनवाई के दौरान सुप्रीम कोर्ट ने कहा कि कहा कि यह प्लेटफॉर्म्स दुनिया में मुफ्त जानकारी के स्रोत हो सकते हैं। लेकिन कानूनी फैसलों में इनका रेफरेंस देते वक्त हमें थोड़ी सावधानी बरतनी चाहिए। कोर्ट ने कहा कि हम ऐसा इसलिए कह रहे हैं क्योंकि ज्ञान का भंडार होने के बावजूद यह प्लेटफॉर्म्स पूरी तरह से भरोसेमंद नहीं हैं। इसकी वजह यह है कि इस पर आम लोगों द्वारा बिना किसी निगरानी के जानकारी लिखी और एडिट की जाती है।
ऑथेंटिक सोर्स का दें हवाला
सुप्रीम कोर्ट ने कहा कि अदालतों और निर्णायक अथॉरिटीज को फैसलों के लिए अधिक भरोसेमंद और ऑथेंटिक सोर्सेज का हवाला देना चाहिए। सुप्रीम कोर्ट ने इस दौरान कमिश्नर ऑफ कस्टम्स बेंगलुरू बना एसेर इंडिया प्राइवेट लिमिटेड (2008) 1 एसएससी 382 का भी हवाला दिया। इस फैसले में कहा गया था कि विकिपीडिया एक ऑनलाइन इनसाक्लोपीडिया है। यहां पर कोई भी ऐसा व्यक्ति सूचना डाल सकता है जो ऑथेंटिक न हो।
यह था मामला
यह केस एक कंप्यूटर आयात के टैरिफ से जुड़ा हुआ था। कंपनी ने किसी अन्य टैरिफ से कंप्यूटर का एसेसमेंट किया था। बाद में कस्टम की जांच में इसका टैरिफ भिन्न पाया गया। असिस्टेंट कमिश्नर ऑफ कस्टम्स और कमिश्नर ऑफ कस्टम्स (अपील) ने भी दूसरे वाले टैरिफ को सही बताया। बाद में कस्टम्स, एक्साइज एंड सर्विस टैक्स अपीलीय ट्रिब्यूनल ने भी इसे सही ठहराया। सुनवाई के दौरान सुप्रीम कोर्ट ने इसे सेंट्रल एक्साइज टैरिफ एक्ट 1985 से के फर्स्ट शिड्यूल से जुड़ा बताया। कोर्ट ने कहा कि एडज्यूकेटिंग अथॉरिटीज, खासतौर पर कमिश्नर ऑफ कस्टम्स (अपील) ने अपने आदेश में कंक्लूजन के लिए विकिपीडिया जैसे ऑनलाइन सोर्सेज का बहुत ज्यादा इस्तेमाल किया है।
